Terms of use

These terms govern the use of the WafyCard platform by guests of participating restaurants. Separately agreed B2B terms apply additionally for restaurant operators.

WafyCard lets guests store a digital loyalty card of a participating restaurant in Apple Wallet, Google Wallet or as a web card, collect stamps and points, redeem coupons and receive offers from the restaurant via push notifications.

3. Contracting party of your loyalty programme

The respective loyalty programme (conditions for stamps, rewards, coupons, minimum spend) is set by the individual restaurant. The holder of the loyalty programme and the contracting party for redeeming the benefit is exclusively the restaurant, not ALGEBRA Engineering & Consulting GmbH.

4. Beta notice

WafyCard is in public beta. Individual features may change, fail or be temporarily unavailable. During beta, participation is free for guests and restaurants. We strive for continuous availability but do not guarantee any specific SLA.

5. Sign-up & account

You can use WafyCard as soon as you save a WafyCard pass of a restaurant. For sign-up we only ask for the data that is strictly necessary. You confirm that your details are truthful and that no third-party identities are used.

6. Push notifications

When you save the card you receive operational card updates (stamp and point balance). You only receive marketing push (offers, reminders) if you consent. Consent can be revoked any time under "My data".

7. Coupons & redemption

Coupons are redeemed with a 6-character code that is valid only once per use. Acceptance or refusal of a coupon at the counter lies with the restaurant's reasonable discretion in line with the applicable coupon terms.

8. Liability

ALGEBRA Engineering & Consulting GmbH is liable for wilful misconduct and gross negligence. For slightly negligent breaches of duty, liability is limited to the foreseeable damage typical for the contract; in case of breach of material contractual duties we are also liable for slight negligence, limited to the damage typical for the contract. Liability for injury to life, body or health remains unaffected.

9. Termination

You can terminate your WafyCard account any time under "My data" → "Delete account". The card is deactivated immediately, all personal data is fully deleted after 30 days (details see privacy policy).

10. Applicable law, jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. As far as legally permitted, place of jurisdiction is Stuttgart. Mandatory consumer-protection rules of the consumer's country of residence remain unaffected.

11. Changes

We may amend these terms when legally or technically required. We'll inform you about material changes in advance via push or email with reasonable notice.
